ينص الدستور على أن الرئيس يرشّح، لا أنه قد يرشّح إن شاء، أو لا يرشّح إن لم يشأ، بل يرشّح. والمضمر في الدستور أن مجلس الشيوخ سيؤدي مسؤوليته الدستورية ويُبدي مشورته وموافقته. ولا يُلزم أحد بالتصويت للمرشح.
