الفرق الجوهري بين الحكم الإسلامي من جهة، والملكية الدستورية والجمهوريات من جهة أخرى، هو هذا: فبينما يتولّى ممثلو الشعب أو الملك في تلك الأنظمة التشريع، فإن السلطة التشريعية والحق في وضع القوانين في الإسلام تعود لله سبحانه وحده.
