كيف نوقف هذه التعديات غير الدستورية على الحقوق من السلطة القضائية الاتحادية؟ ليس أولًا بالعزل، بل بأن يُعلن مجلسا الكونغرس معًا احتجاجًا قويًا بأن مبادئ بعينها أقرّتها المحكمة العليا تخالف الدستور؛ فإن عادت بعد ذلك إلى الضلالات ذاتها، فعندئذٍ يُعزلون ويُتركون وشأنهم. فما قُسّمت الحكومة إلى ثلاث سلطات إلا ليراقب كلٌّ منها الأخرى، ويقف في وجه تغوّلها.
