لا تستطيع السلطة التشريعية أن تنقل سلطة سنّ القوانين إلى أيدٍ أخرى؛ لأنها سلطةٌ مفوّضة من الشعب، ومن يملكها لا يستطيع أن يسلّمها إلى غيره. والشعب وحده له أن يحدّد شكل الدولة، وذلك بتأسيس السلطة التشريعية، وتعيين من يتولاها.
