بينما يعدّ الدستور الأمريكي هذه البرامج غير قانونية، تزعم حكومتي أن أحكاماً قضائية سرية، لا يُسمح للعالم بالاطلاع عليها، تُضفي الشرعية على علاقة غير مشروعة. إن هذه الأحكام تُفسد ببساطة أبسط مفاهيم العدالة، وهو أن يُرى أنها تحققت. ولا يمكن لما هو غير أخلاقي أن يصير أخلاقياً باستخدام قانون سرّي.
