القواعد التي تظهر في صورة قانون تمنح الفاعلين حقّ ممارسة حقوقهم وحرّياتهم. غير أنّ المرء لا يستطيع أن يحدّد أيّ هذه القوانين مشروع بمجرّد النظر إلى صورة الحقوق الفردية. لا يتبيّن ذلك إلا بإدخال مبدأ الخطاب، فيُظهر أنّ لكل إنسان حقًّا في أكبر قدر ممكن من الحريات المتساوية المتوافقة فيما بينها.
